| 内容記述 | 本稿は、贈与（寄贈）、売買、寄託といった手段により収集された民間アーカイブズを、利用に供する上において検討すべき法的課題を対象とするものである。 「物」としてのアーカイブズを収集すると、あたかもそれを自由に利用する・させることが可能であるかのような錯覚に陥るかもしれないが、それは誤りである。なぜならば、民間アーカイブズは、「物」としての性質の他に、「情報が記録されたもの」という性質を持っているからである。後者の性質から、民間（収集）アーカイブズを利用に供する上では、著作権、プライバシー権、肖像権との関係に留意しなければならないことになる。 本稿では、これらの権利についての基本的事項を確認するとともに、それを収集アーカイブズとして利用に供する上での留意点や法的課題について検討した。 検討の結果、収集アーカイブズを利用に供する上で用いられている、閲覧、写しの作成・交付、デジタル化・公衆送信、展示といった方法のそれぞれにつき、いかなる権利との関係が問題となり得るかを整理し、その権利が現行法制度の下でどの程度まで制限され得るかといった点を、ある程度明らかにすることができたと考える。 This paper explores some of the legal issue surrounding the use of private archives which have been donated to, purchased by, or deposited in public and private institutions. It is a common misconception to think of archives simply as collections of “materials” which may be freely used by their owners and made to be used by others, because they are simply “materials”. Quite the contrary, private archives, while they certainly are materials, are, more properly speaking, materials upon which information of one sort or another has been recorded, for which reason one must consider issues of copyright, privacy, and image rights. This paper endeavors to clarify some of the fundamental legal points pertaining to these issues, especially in regards to the public use of privately archived material. I hope to make clear which legal rights apply, and to what degree they apply, to each of the various ways in which private archives might be used, including such things as reading, making and issuing of copies, digitalization, public transmission, and exhibition of their materials. |
