| 内容記述 | 王朝貴族社会では、密通が法的に罰せられることはなく、また、本夫が密通に対して暴力による私的制裁を加えることも許されなかった。しかし、それは法制度がそうだったからであり、王朝貴族社会に生きた男たちが、妻妾の密通に対して平気であったわけではなかった。彼等は、心情としては復讐したいのだが、法が復讐を認めぬ以上、今までに与えていた恩恵を停止するという手段によらざるをえなかった。それは天皇の場合も同じであるが、天皇は官職の任命権、殿上を許す権利、など、全ての臣民に恩恵を与える立場にあり、それゆえその恩恵を停止できた。しかし、僧侶の密通を除いてはそれ以上の処置を施すことは出来なかった。そして、密夫に恩恵を与えていない場合（言い方を換えると密夫が権力下にない場合）、いかなる処罰も与ええなかった。 In a society of royalty and nobility adultery was not punished legally, it was also not allowed that legal husband adds the act of punishing his wife privately and brutally. However that was because of the legal system, men who lived a society of royalty and nobility were not all fine for adultery of wives and concubines. They wanted to revenge as their feelings, there was no other means that they stopped the benefit that they gave to their wives so far. It was the same in the case of the Emperor, however he was in the position of an appointer of the government posts, the right to forgive a court noble, and that was why he could stop benefit. Although except adultery of the priest, he could not take further steps. And in case of not to give an adulterer benefit (in other words, the adulterer was not under the authority), he did not punish at all. |
